What Can Get a Notary in Trouble? Real Cases You Should Know About!

Kendra Marroquin

Notaries are trusted public officials, and with that trust comes serious responsibility. Even small mistakes or lapses in judgment can have huge consequences, from lawsuits to losing a notary commission—or worse. Here are real-life examples of what happens when things go wrong:

Failing to Require the Signer’s Presence

A notary in Ohio notarized deeds for homeowners who weren’t present.

Result: The deeds were used in a scam to steal four homes. The notary lost her commission, faced criminal charges, and is no longer in business.

Accepting a Photo of an ID

A California notary used a photocopy of an ID instead of verifying the original.

Result: The signer was an impostor, and the notary was sued for $180,000. The case settled for $25,000, but the damage to the notary’s reputation was done.

Missing Required Details

Another California notary failed to collect a required thumbprint for a real estate transaction.

Result: The signer was a scammer. The title company sued for $250,000, and the notary’s insurer settled for $50,000.

Fraudulent Notarizations

A North Carolina attorney notarized signatures without the signers present.

Result: Disbarred, criminally charged, and lost her law license.

Notaries play a critical role in protecting the integrity of legal transactions. Mistakes—or intentional shortcuts—can lead to lawsuits, financial losses, or even jail time.

How I Stay Above Board:

As a notary in Washington State, I take extra steps to ensure every notarization is done right:

Verify ID properly—no exceptions.

Follow the law—no shortcuts, no favors.

Keep detailed records in my journal to protect everyone involved.

Stay impartial—even if it’s inconvenient.

Your trust is my top priority. That’s why I always go the extra mile to make sure every notarization is done correctly, securely, and with integrity.
